wsj logoApparently some people in the Finance industry like to read my blog. iGuess i make projections and can usually tell and/or what will work. Perhaps that is why i am quoted in today’s Wall Street Journal.wall street phone

Besides, a blog is much easier to read than sitting through a cNet review or “expert” Meltdown on YouTube that flip out over whatever Chief Economist Ben Bernake is doing down at the Fed. Most of you are techies and more interested in either the 2.0 weblog network or what i’ll say next anyway.

Either way, iHave written about my Blackberry, compared it to the iPhone and was onsite, the for the first iPhone that they gave out publicly in the Manhattan Apple store. Perhaps that is why i was chosen, I’m not sure, but like to talk tech and people are starting to notice. It’s an incredible world when you can be riding along the ocean and answer your phone while people think you are in an office. Such is the power of communication. Court rejects OUR plea for NET RADIO relief!

A federal appeals court has declined to grant a petition by Webcasters to delay the onset of new royalty fees that they argue could imperil their offerings.

In a one-page order filed late Wednesday, the U.S. Court of Appeals for the District of Columbia said the opponents of the fees “have not satisfied the stringent standards required for a stay pending court review” and rejected their request for an emergency stay.

Barring an 11th-hour agreement, then, between Internet radio operators and the music industry, the new fees are scheduled to kick in on Sunday.

Jonathan Potter, executive director of the Digital Media Association, whose members include larger Internet radio operators like Yahoo, Live365, Pandora and RealNetworks, said he was hopeful Webcasters could still reach a compromise with the music industry.

But until then, Webcasters will be “forced to make very difficult decisions about what music, if any, they are able to offer,” he said in a statement. “The result will certainly be fewer outlets for independent music, less diversity on the Internet airwaves, and far fewer listening choices for consumers.”

The new rules (PDF) issued by the U.S. Copyright Royalty Board earlier this year prescribe rate hikes of 0.08 cent per song per listener retroactive to 2006. They would also climb to 0.19 cent per song by 2010. According to the advocacy group SaveNetRadio, smaller Webcasters could face payment increases of up to 1,200 percent of what they owed before, while larger ones could owe up to 300 percent more.

Each station would also have to hand over a minimum $500 royalty payment per “channel” under the ruling, which DiMA says could cost the three largest Net radio operators–Yahoo, RealNetworks and Pandora–more than $1 billion in the first year alone.

SoundExchange, the nonprofit entity that collects the fees, was not immediately available for comment on the decision Thursday.

The group has offered two attempted compromises to the Net radio industry, but they haven’t gone far enough to meet the Webcasters’ wishes thus far. First, it attempted to extend a peace offering to smaller Webcasters by saying it would freeze through 2010 the “below-market” rates they have been paying since 1998. But Net radio advocates said that would effectively discourage smaller firms from growing their operations. More recently, the group also reportedly to cap at $2,500 the $500 per “channel” minimum fee for all Webcasters but, according to DiMA, only through 2008.

If an accord can’t be reached, Congress may need to step in and pass a bill that would overturn the CRB’s ruling, said Rep. Jay Inslee (D-Wash.), one of the sponsors of the House of Representatives version. His bill proposes leveling the royalty rates for all digital broadcasters–satellite, cable and Internet–at 7.5 percent of their revenues.

“I hope a compromise between online radio broadcasters and record labels can be reached before then, but if the hammer drops, urgency for congressional action only increases,” he said.

15,000 page views for the 100th post.

Hi readers,

Thanks for keeping up to date with Apple, Inc. & Things i Think. This is the 100th post for Thunk Different since we began posting on April 20th, 2007. We also reached over 15,000 views yesterday, added Digg, del.icio,us,bob thunk FARK, newsvine, and other RSS readers to the base of every posting starting yesterday. If you go back and check you will see a few more than that b/c i added them on popular posts.

What has ThunkDifferent done thus far?

Gotten the word out. The amount of news that Apple & readers like you come up with is astounding. It is so much fun to write about and thanks for the questions, i always love to get fan mail. i’m sure i will be better to keep better track of all of the other Apple RSS feeds now as i recent downloaded a news reader myself, turning 2.0 is a journey, not a destination. (or at least one i fully understand at this time anyway.)

What can we expect in the near future?

The Thunk Different podcast. Fo’ Sure. i started podcasting in January of last year if you would like to check out some of my old shows, just google “expatpodcast” or go to expatpodcast.blogspot.com. i have moved over to wordpress since then and am glad to say i am quite happy with them.

WWDC, Whatcha think?!

Oh hell, i don’t know. i think that leopard will (hope) surprise. i have been reading about its architecture on some of the developer blogs and they have some interesting things to say. i personally think that in the next year we will see smaller more energy efficient chips from intel and AMD, touch screen imacs, and a big update to .mac service with iphone integration into the laptops, Apple TV, and more Google apps.

This past weekend i took a Megabus trip from Chicago to Detroit Rock City. Exciting. The reason i went was threefold. Visit Friends, Coney Dogs, and the 2007 DEMF, Detroit Music Festival. Richie Hawtin, Booka Shade, King Britt, and other people i was kind of heard of. It was cool tho, a lot of break dancing, call & response, people running in the fountain, boats going by the river that separates Detroit from Windsor, Canada. You should have been there… maybe next year eh? Well if you go, bring a digital camera to take a pictures of some of the set-ups the djs and mc’s got hooked up. There were plenty of Mac Book Pros to be had, as electronic music and the best hardware do go hand in hand.

iTunes to lose Radio Feature?!

i recently came across the news at the apple blog that iTunes isSave net radio! likely to lose their radio stations. This would be devastating to many offices, homes, and campuses around the globe. Not only iTunes, would go, but almost every net radio station out there, podcasts, web casts, and every audio creative is affected by this. DO Something.
